Hernán Torres Aguirre, head of legal of Penguin Random House Grupo Editorial in Chile, is an IP specialist with a strong background in the publishing industry. He started his career at a trademark and patent registration company, and later had the opportunity to specialise in the area, achieving a Master’s degree in law and new technologies. A passion for his subject expertise led him to his current role in 2016, focusing on IP-related matters at Penguin Random House publishers. In his role he leads the local trademark registration of all the distinctive names of the company; starting local legal actions against counterfeit products establishing a rigorous process before and after signing agreements and helping with implementing the compliance structure in the local company. Involving his excellent IP background, Torres Aguirre’s role involves other specific knowledge from different areas of law, such as labour law, corporate law, antitrust, intellectual property, and even sometimes criminal law. He highlights that ‘working as an in-house attorney in a company that has many other areas gives you a greater understanding of the world and the business, not only related with the legal aspects, but also regarding the commercial and business stand point. This has made me a more flexible professional, who is concerned with the growth of the company and avoiding the real risks of the business’. Torres Aguirre also serves as a counsel in the Literary Collective Management Association SADEL, for the collective management of literary rights.
