What are the most significant cases or transactions that your legal team has recently been involved in?
Most recently, we have negotiated a transaction/settlement agreement with an Italian contractor who build a hydro power plant and still owed our company US$30m, according to with the awards of the ICC, however it is bankrupt. Additionally, we have participated in the negotiation of an EPC contract with a Chinese contractor for the construction of a 500 MW solar farm in the north of Chile, as well as participated in the project finance of the solar farm, interacting with local and foreign law firms and lender’s counsel. Lastly, we have supported and advised a shareholder Chinese team in a M&A deal in Peru, and participated in at least three due diligence processes and legal support for M&As and in the Greenfield projects (solar and wind) in Chile.
What diversity, equity and inclusion initiatives have you and your legal department been championing within your company’s endeavours?
I have always promoted the company’s diversity, inclusion and equity efforts. The legal team has two attorneys and one assistant who are women. We do not have quotas. The people I have on my team are the most suitable for the roles.
If existent, can you talk about you or your company’s efforts relating to renewability, sustainability or other environmentally friendly activities?
Pacific Hydro generates energy in a clean and sustainable way, 100% percent renewable, and we do it with full respect for communities. All our assets and current projects pipeline are “green” (hydro, solar, wind). Thermal energy (coal, gas, fuel) is not acceptable at all.
