Javier Carrasco
General counsel (legal, environmental, compliance and human resources manager) | Tinguiririca Energía
What are the most significant cases or transactions that your legal team has recently been involved in?
Most recently, our legal team has been involved in the closing of an environmental compliance program before the Superintendency of the Environment; in the closing of negotiations with the Union regarding a new labour agreement; in the incorporation of a new transmission company; in the improvement of work climate over the past 3 years; and in the closing of amendment to a PPA with big energy consumer.
How important is choosing to work with external lawyers who align with your company’s values? Are you likely to reconsider what firms you work with based on this?
It is very important, since sometimes the legal analysis conflicts with the corporate governance of the company or the value of the shareholders, usually in health and safety issues or environmental matters.
What are some of the main legislative or regulatory changes that have impacted you?
First, the amendment to the Chilean Water Code, since we are a hydropower company, and second, the upcoming replacement of the Political Constitution.
