How do you approach managing legal aspects during periods of instability or crises, and how does your legal strategy align with the broader business strategy to ensure the organisation’s resilience?
Without a doubt, the most important role of an in-house legal department is to stay closely connected to the business areas, deeply understand how the business operates, and align with the organization’s KPIs and priorities. This enables the legal team to provide sound advice that balances risks and opportunities for the business and its stakeholders. In times of instability or crisis, if this approach is maintained, the handling of legal matters should remain consistent, regardless of the circumstances.
What measures has your company taken to embed sustainability practices into its core business operations, and how does the role of the general counsel contribute to driving and ensuring sustainable practices within the company?
UPL has made significant strides in sustainability. One of the most notable achievements is the substantial portion of its product portfolio now dedicated to biosolutions. These products, formulated from natural ingredients, offer a sustainable option for farmers by significantly reducing chemical usage, resulting in healthier, safer, and higher-quality foods. UPL’s commitment to sustainability in the LATAM region is further demonstrated by the establishment of a major research center in Saltillo, Mexico. Additionally, UPL provides ongoing training for farmers on the proper use of its products, ensuring efficient and safe application while safeguarding farmers’ well-being and promoting sustainable waste management. A prime example of this effort is the “Apply Well” program, which is implemented in several countries across the region. The role of the General Counsel in these initiatives is crucial, as it involves supporting the development and execution of projects from start to finish, providing legal guidance to teams, and maintaining a holistic view of the projects.
In your opinion, what are the main trends that are salient in your country currently (these can be legal, political, economy or business-based)?
In Chile and across Latin America, we are witnessing significant political changes that have resulted in pronounced polarisation. This situation affects national economies, the region’s attractiveness for investment, and regulatory environments. Many countries have already implemented reforms and initiated projects across various areas, including labor, environmental, antitrust, and data protection. As in-house lawyers, we must work proactively to anticipate and prepare for these regulatory changes, helping businesses adapt and drive the cultural shifts they necessitate.
