What measures has your company taken to embed sustainability practices into its core business operations, and how does the role of the general counsel contribute to driving and ensuring sustainable practices within the company? 

At Bayer, our diverse portfolio presents unique challenges when it comes to sustainability. Each of our business sectors—crop science, pharmaceuticals, and consumer health—requires tailored approaches. For example, our crop science division faces distinct environmental challenges, while our pharmaceutical and consumer health sectors grapple with different sustainability issues, some of which aren’t directly tied to operations. It’s worth noting that here in Chile, we don’t produce pharmaceutical products, so our sustainability challenges focus more on ensuring the longevity and ethical integrity of our business practices.

The legal department plays a crucial strategic role in this context. Our responsibility is to anticipate and mitigate potential future impacts of today’s operations. This involves not just complying with regulations to avoid future claims but also evaluating risks in every project or development we undertake. I often say that compliance is a fundamental aspect of sustainability. It’s about looking ahead and ensuring that our actions today don’t compromise our success in the years to come.

Challenging the status quo in a sustainable manner is also essential. This means constantly innovating and introducing new tools and approaches. To do this effectively, the legal team must stay closely connected to the business. I believe in getting out of the office and into the field regularly—whether that’s visiting agricultural sites to understand crop operations or accompanying pharmaceutical teams to see how we interact with healthcare providers and stakeholders. This hands-on experience is crucial for truly understanding where risks lie and how we can enhance our sustainability efforts in the short, medium, and long term.

In-house lawyers, in my view, are fundamentally risk managers. Our focus isn’t just on immediate profits but on ensuring that our actions today yield consistent or improved results in the future. Sustainability, for me, is about living the law—ensuring that our business practices today set us up for success tomorrow. To achieve this, we must stay close to the core of our operations and fully understand how everything works.

 

How do you prioritise diversity and inclusion within your legal department, and what initiatives have you implemented to foster a more inclusive and equitable work environment?

I’m part of Bayer’s Business Resource Group (BRG) called “Blend In,” which is dedicated to promoting LGBTQ+ rights within the company. Additionally, I’m deeply involved in our “Fight Connection” network in Chile, working tirelessly to advance these causes. Being a member of the LGBTQ+ community is important to me, but I realised early on that simply being part of the community wasn’t enough. I recognised that if I, with my relative privilege, didn’t take action and speak up, who would? This realisation motivated me to become more actively engaged.

At Bayer, we have three vital networks focused on inclusion: “Blend In” for LGBTQ+ rights, “Growth” for women’s opportunities, and “Enable” for people with disabilities. I make it a priority to stay connected with all of these networks, constantly challenging the company to examine and improve our processes. We need to identify where we’re falling short in providing opportunities for diverse groups, particularly in areas where inclusion might not be as strong as it should be.

Bayer operates numerous production sites, particularly in agronomy, where local cultures can often be quite misogynistic and homophobic. In my office role, it’s easy to avoid these issues, but when I visit the field, it’s a different story. This raises an important question: How can we implement deep, meaningful cultural change in environments where local culture contrasts sharply with Bayer’s principles?

To address this, we’ve been conducting training sessions across all sites and levels, aiming to foster a more inclusive environment. These sessions are deeply personal, featuring stories from LGBTQ+ community members and people with disabilities. The impact has been significant: We’ve received more complaints than ever before, which I see as a positive sign. It indicates that people trust the process and feel safe enough to speak up without fear of retaliation.

Moreover, we’ve seen an increase in people coming out and others wanting to join the network, even if they aren’t part of the LGBTQ+ community. This shows that our efforts resonate with a broader audience, helping to create connections that are crucial, especially in our increasingly remote work environment. These networks serve as vital touch points for inclusion and foster the trust and human connection that may have diminished in recent years.
