How do you approach managing legal aspects during periods of instability or crises, and how does your legal strategy align with the broader business strategy to ensure the organisation’s resilience?
Crystal Lagoons enters into long-term agreements with regional partners and local developers around the world. Legal crises may involve many aspects, including force majeure and changes in regulations regarding development, import, export, and payment mechanisms. It is crucial to perform proper due diligence on the local partner and review local laws to ensure the enforceability and protection of intellectual property. A well-balanced agreement between the parties is also essential for maintaining long-lasting relationships with clients, including provisions for direct mediation and negotiation of any differences that may arise.
What measures has your company taken to embed sustainability practices into its core business operations, and how does the role of the general counsel contribute to driving and ensuring sustainable practices within the company?
Crystal Lagoons is a sustainable technology that allows the development, construction, and operation of large water bodies with low energy and chemical use. As part of the company, the legal team is always searching for efficient resources, including paperless document signing and implementing certified signatures for both internal and external document execution.
What emerging technologies do you see as having the most significant impact on the legal profession in the near future, and how do you stay updated on these developments?
Many new technologies are available, especially for drafting agreements, summarising meetings, and creating images. These tools are greatly beneficial for a company that drafts agreements worldwide, designs complex structures, and has a strong marketing team. However, AI tools must be carefully analysed to ensure the confidentiality of information, proper use of third-party intellectual property rights, and protection of the company’s trade secrets and confidential information.
How do you prioritise diversity and inclusion within your legal department, and what initiatives have you implemented to foster a more inclusive and equitable work environment?
Our team is diverse in terms of gender, orientation, age, nationality, and experience. In my opinion, diversity is key to the growth of a team.
In your opinion, what are the main trends that are salient in your country currently (these can be legal, political, economy or business-based)?
Chile is a country open to new developments and technology. Although drafting detailed regulation takes time due to its nature, it is flexible enough to allow the benefits of new businesses, inventions, and improvements that can enhance the development of both companies and the country.
