How do you approach managing legal aspects during periods of instability or crises, and how does your legal strategy align with the broader business strategy to ensure the organization’s resilience?  

During instability or crises, managing legal aspects is crucial for organisational resilience. We incorporate unilateral termination and suspension clauses in contracts for flexibility with vendors and clients. For instance, during the USA writers’ and actors’ strike, these clauses allowed us to cost-efficiently cease contracts with impacted talent in Latin America.  

Our business affairs and legal departments ensure resilience by adapting and finding creative legal solutions while complying with the law. For example, with advice from external counsels, we monitor labour and intellectual property law changes, proactively amending agreements with crew and talent as needed.  

Our legal strategy aligns with the broader business strategy by enabling quick adaptation to changing circumstances without compromising compliance or business objectives. This alignment helps maintain stability and resilience during challenging times. 

What are the main cases or transactions you have been involved in recently?  

Recently, we have been involved in significant productions and transactions.   

Major projects include “One Hundred Years of Solitude” for Netflix, the biggest Latin American production for the platform, set to launch in late 2024.   

We produced award-winning documentaries like “The Double Kidnapping of Sigifredo López” and are working on series in Mexico and Spain.   

Over the past year, we shot over six projects, including movies and TV series for various platforms. We premiered five shows, with two ranking among the most viewed on Prime Video. “La cabeza de Joaquín Murrieta” ranked 7th in the Top 10 most-watched non-English content globally on Prime Video, and “Medellín” is the second most-watched non-English movie on Amazon Prime Video globally.   

We are acquiring books, podcasts, and other materials for unique audiovisual adaptations and applying for Colombian government incentives for series production, promoting foreign investments and creating local employment opportunities. Legal department has reorganised corporations and corporate governance for Dynamo group entities in Colombia, Mexico, and Spain 

What measures has your company taken to embed sustainability practices into its core business operations, and how does the role of the general counsel contribute to driving and ensuring sustainable practices within the company? 

To embed sustainability practices, we conducted a comprehensive survey to understand our workforce, covering gender, race, age, education, disabilities, and other factors across employees in Colombia, Mexico, and Spain. Insights from the survey guide tailored actions for our employees’ benefit. We will analyse salary ranges to propose equal conditions, promote environmental education through campaigns on energy consumption, waste management, and green spaces, and encourage self-care events and integration activities for workplace well-being.  

Our commitment to environmental care is reflected in three productions that received EMA (Environmental Media Association) certifications.  The legal department plays a crucial role in driving sustainable practices. We draft and review legal documents for data collection and confidentiality clauses for the survey and include environmental protection clauses in vendor contracts to ensure our sustainability commitment, for example.
