Firstly, can you give us an idea of the type of work your team has done recently? 

Since 2020, with the amendment of Law 87-01, which created the Dominican Social Security System (SDSS), the Tesorería de la Seguridad Social (TSS) has been strengthened in terms of its functions and autonomous financing, allowing it to bring direct legal action against employers whose actions harm and affect the rights of workers, and those who threaten the economic balance of the system through fraudulent actions, as well as the imposition of sanctions on its regulated parties for failure to comply with their duties and responsibilities with regard to social security. In this regard, a new organisational structure has been designed to strengthen the legal directorate to attend to these new functions effectively and efficiently. On the other hand, in terms of regulations, the most important project implemented was the modification of the functional regulations of the TSS, to adapt the processes and operations of the institution, which was approved by Decree No. 290-23 dated July 7th of this year.
 

How do you keep up to date with changes in Dominican laws and regulations relevant to your organisation’s industry? 

One of the great challenges in the area of social security lies in the dynamic nature of its complementary regulations, derived from the regulatory powers held by most of the institutions that govern and manage the system, and the need to adapt it to the socio-economic reality of the States, and to the international principles related to the insurance that comprise it, in our case: health; old age, disability and survivors; and occupational hazards. The TSS maintains an active and participatory follow-up on these complementary regulations, since, to a large extent, implementation must be carried out through the Single Information and Collection System (SUIR) administered by the Treasury, which constitutes the technological platform that integrates the general information on employers and workers, as well as the collection of the contributions made and their subsequent individualisation and dispersion to the different entities of the SDSS.
 

What is one cause, business related or otherwise, that you care about and why? 

Personally, I strongly support the fight against fraud in the social security systems, especially from my territorial area and functions from the TSS. Fraud is the unlawful action through which people try to access the benefits of social protection provided by the systems, through a financing system that does not correspond to the socio-economic reality of this alleged beneficiary. Which leads to a financial deficit in the contributory system, because of the insufficiency of the amounts collected at the time of their distribution, thus damaging the principle of solidarity, a fundamental pillar of social security since its origin, putting its continuity and economic stability at risk.
