How do you approach managing legal aspects during periods of instability or crises, and how does your legal strategy align with the broader business strategy to ensure the organisation’s resilience?
In my opinion, in-house counsel plays a pivotal role in guiding the company through legal complexities during a crisis, ensuring compliance, and helping to maintain stability and resilience. Some key strategies that would provide a proactive and integrated approach during periods of instability or crises would be quickly identify legal risks associated with the crisis (i.e. regulatory breaches, contractual obligations and potential litigations) and create and develop mitigation strategies to mitigate these risks; ensure that the legal strategy is align with the business objectives; work closely with others departments to establish a clear, transparent and unified response to the crises; supervise any necessary internal investigation in order to better understand the cause of the crisis, this will help to develop or update policies and procedures to prevent similar crises in the future and be prepared to adapt legal strategies as the situation evolves.
What emerging technologies do you see as having the most significant impact on the legal profession in the near future, and how do you stay updated on these developments?
Certainly, emerging technologies are set to significantly transform the legal profession. I consider that Artificial Intelligence (AI) is impacting the practice of law in many ways i.e. legal research, contract analysis, fill out basic legal forms, draft of documents and so on. In my opinion, integrating AI tools will significantly enhance efficiency, accuracy and overall productivity in the legal practice. Of course, it is important to ensure AI tools are used ethically and comply with all relevant legal standards. To stay current with new technologies that will help my practice, I enroll online courses on platforms like LinkedIn Learning, join webinars and follow blogs from legal tech companies and subscribes to their newsletters, attend and join international law organisations for access to resources and AI focused legal events.
What are the main cases or transactions you have been involved in recently?
In 2023 and throughout 2024, I have led the legal aspects of the projects managed by our company and related to its main activity. I also continue to contribute through our participation in the company’s internal management committee, providing legal insight regarding business decisions that are being or will be implemented.
Additionally, I actively participate and get involved in the various committees of the associations to which our company belongs and that are related to its activity. For example, we are members of the fiscal affairs commission and the corporate social responsibility commission in the most important industry association in the Dominican Republic. It is important to highlight that currently, an important tax reform is being discussed in our country, and through the working committees, we have reviewed and submit our observations and modifications that will improve this tax reform proposal.
