How do you approach managing legal aspects during periods of instability or crises, and how does your legal strategy align with the broader business strategy to ensure the organisation’s resilience? 

During periods of instability or crises, my approach prioritises proactive risk management and clear communication. I closely monitor potential legal risks and maintain an agile response plan, allowing the legal department to adapt swiftly to changing circumstances. My legal strategy aligns with the broader business strategy by focusing on safeguarding the company’s assets, supporting business continuity, and ensuring regulatory compliance. 

A crucial element of my approach is the support and cohesion within my team. I view my team as the backbone of the department; we work together like a family, supporting one another to address emerging needs. This strong sense of collaboration and team spirit enhances our ability to tackle challenges effectively, thus bolstering the organisation’s resilience. 

What are the main cases or transactions you have been involved in recently? 

Recently, I led the legal team in negotiating and establishing business operations in a new country, which expanded our market presence and increased shareholder value. Additionally, I managed a high-profile litigation case involving complex labour and regulatory issues, achieving a favourable outcome for the company. 

Another significant aspect of my work involved negotiating and managing contracts with suppliers in China, including site visits to factories to ensure compliance with contract terms. I also negotiated a contract with one of the most prominent appliance brands in the United States, covering the manufacturing, sales, and distribution of appliances both locally and internationally. 

Moreover, I actively participate in local NGO committees, contributing my legal expertise to support social and community causes. These experiences underscore the importance of strategic legal counsel in driving successful business outcomes and highlight my commitment to corporate social responsibility. 

What measures has your company taken to embed sustainability practices into its core business operations, and how does the role of the general counsel contribute to driving and ensuring sustainable practices within the company? 

In 2024, I am spearheading a strategic project to integrate climate change considerations into the company’s Process Map. This initiative aims to incorporate aspects of climate change as a critical factor in achieving the objectives of each management system and assessing its impact. This integration is in line with ISO Standards, particularly ISO 9001 and the recent amendment published by ISO in February 2024. The process involves engaging with stakeholders who have an impact on and responsibility for environmental protection across all management areas. 

What emerging technologies do you see as having the most significant impact on the legal profession in the near future, and how do you stay updated on these developments? 

Artificial intelligence, blockchain, and big data analytics are emerging technologies poised to significantly impact the legal profession in the near future. Artificial intelligence is revolutionising the handling of large volumes of information by enabling faster and more accurate analysis of legal documents and automating repetitive tasks. Blockchain offers a secure and transparent method for managing transactions and contracts, potentially transforming areas such as intellectual property and supply chain management. Big data analytics allows lawyers to extract patterns and trends from vast datasets, enhancing decision-making and legal strategy. 

To stay informed about these developments, I regularly attend conferences and seminars on technology and law, participate in discussion groups and online forums, and keep up with specialised publications on legal technology. Additionally, I maintain a network of professional contacts with technology experts, which helps me stay abreast of the latest innovations and their applications in the legal field. 

In your opinion, what are the main trends that are salient in your country currently (these can be legal, political, economic, or business-based)? 

In the Dominican Republic, several key trends are emerging across legal, political, economic, and business sectors. Digital transformation and technology are at the forefront, with the adoption of artificial intelligence and blockchain improving efficiency and transparency in both public administration and the private sector. Legal and regulatory reforms are adapting to new economic and technological realities, aiming to enhance the business climate, attract foreign investment, and protect workers’ rights. 

Economic growth is robust, with a focus on sustainable development that balances economic growth with environmental protection and corporate social responsibility. Efforts are underway to strengthen the rule of law, including measures to combat corruption and improve governmental transparency and judicial efficiency. The impact of remote work, accelerated by the COVID-19 pandemic, is leading to changes in labour legislation to govern and protect workers’ rights. Additionally, studies on reducing working hours aim to improve workers’ quality of life and productivity, potentially leading to significant labour law reforms.
