What are the most significant cases or transactions that your legal team has recently been involved in?
The most important transaction in which we have been involved recently, is the finalisation of the agreements (through a thorough due diligence between 2018-2023) for the final closing of the operation of a minority stake of Industrial Pesquera Santa Priscila by the Japanese company Mitsui & Co.
As we live in a fast-paced world today, what skills will a corporate legal team need to succeed in the modern in-house industry?
I believe that today it is very important not only to be able to handle the law as such, but it is also very important to be able to ensure the knowledge of the company in which you work. It is also crucial to keep up date with the laws, economic policies and, especially, with the corporate policies. Today’s modern world demands that the legal team be prepared to face any concern or problem that may emerge.
If existent, can you talk about you or your company’s efforts relating to renewability, sustainability or other environmentally friendly activities?
The Ecuadorian state, through a legal action brought by IPSP, recognised the violation of IPSP’s rights due to the abuse that personnel of the ecological reserve have attempted to exercise over this company, which constitutes a productive matrix that generates wealth for the country.
The right of nature to be used in a responsible manner has been recognised in the decision, which is addressed in the decision as the principle of sustainable development, which is nothing more than the use of natural resources in such a way that they are not depleted and can be enjoyed by our children and grandchildren.
It has even been recognised that the RAMSAR Convention brings with it the responsibility to guarantee the responsible use of wetlands through the implementation of activities with eco-friendly technology and practices.
In summary, a great first step was taken to benefit the protected area and nature in general, since the competent authorities have been given the obligation to detect the activities that have been irresponsibly developed in the sector.
