What strategies do you employ to ensure your legal advice is effectively aligned with the unique regulatory environments and cultural nuances of different LATAM countries?
In the renewable energy sector, particularly as an EPC contractor, we employ a proactive, localised approach. We maintain a deep understanding of the legal frameworks, regulatory landscapes, and cultural contexts specific to each country where we operate, such as Mexico, Colombia, and Peru. We closely monitor legislative changes in environmental laws, land acquisition regulations, and energy sector policies. In Colombia, for example, we align our advice with local environmental impact assessments and community engagement requirements to ensure smooth project development.
To navigate cultural nuances, we work with local legal experts and consultants who offer insights into business practices and cultural expectations. This collaboration ensures that our legal strategies not only comply with regulations but also resonate with local stakeholders and authorities, minimising delays and fostering trust.
What are your organisations plans in the LATAM region over the next 12 months and how will your legal expertise help to achieve these plans?
Our organisation plans to expand its solar energy projects, with a strong focus on Colombia due to its growing renewable energy market. Over the next 12 months, we intend to increase project capacity and secure long-term contracts.
Our legal department plays a critical role in these initiatives. We will focus on contract negotiations, ensuring compliance with local laws, and managing risks associated with the EPC contracts.
What specific challenges have you encountered when managing legal issues related to Latin American markets from a European perspective, and how has your team addressed these challenges?
Managing legal matters in LATAM from a European perspective presents challenges, such as shifting regulatory landscapes. In Colombia, for example, we’ve encountered complexities related to local content requirements, which mandate the use of domestic suppliers and labor for certain projects.
To address these challenges, our legal team has established a dual-focused strategy. First, we rely on local counsel who possess on-the-ground expertise and an understanding of the jurisdictional nuances. This collaboration ensures that our advice remains current and effective. By blending local expertise with global best practices, we mitigate risks and maintain operational efficiency across diverse markets.
