Could you please share the most significant cases or transactions in the LATAM region that you or your legal team have recently been involved in?

Development, construction and financing of Renewable Energy assets in Uruguay and Mexico (these occurred when I was wording in my previous company, however both transactions were pioneering (first one in Uruguay for renewable energy financed by multilateral parties and large-scale project in Mexico supported by US and local firms). Both comprising an investment of more than €300mn.

What strategies do you employ to ensure your legal advice is effectively aligned with the unique regulatory environments and cultural nuances of different LATAM countries?

We are leading in-house the regulatory and legal strategic approach. We are normally supported by local firms for regulatory matters. Success is based on the establishment of the correct corporate structure from scratch, so it allows correct funding, allocation of risk, easy exits and assess better the potential tax implications.

What specific challenges have you encountered when managing legal issues related to Latin American markets from a European perspective, and how has your team addressed these challenges?

Political and change in law risks, tax alignment with general corporate local Company policy, general divestment issues when doing a corporate transaction (new jurisdictions added) and unreputable courts for dispute resolutions.
