What are the most significant cases or transactions that your legal team has recently been involved in?

The legal team of Shanghai Pudong Development Bank (SPDB) Hong Kong Branch has always been adhering to a professional-oriented, service-first approach, continuously expanding the width, depth and breadth of legal service, and achieved significant results in recent years in major projects, such as providing legal support to SPDB, participating in the book-keeping and pricing of the People’s Government of Hainan Province’s issuance of RMB5bn offshore RMB government bonds, which is the first issuance of blue bond and sustainable development bond issued by a Chinese local government in the international capital market; providing legal and risk management support for SPDB Risk Hedging, a flagship product of SPDB Hong Kong Branch; providing legal support for the cooperation between the SPDB Hong Kong Branch and OTC Clearing Hong Kong to promote SPDB Hong Kong Branch’s trading of foreign exchange and interest rate derivatives; and leading the entire process legal support work for Greater Bay Area Cross Border Wealth Management project.

Apart from legal matters, has the team worked on other company initiatives?

Apart from legal matters, the team has also completed a series of publications such as ‘A Collection of Typical Cases of Financial Regulation in Hong Kong’ and ‘Basic Policies and Regulations for Personnel in the Hong Kong Banking Industry’.

The team is very dedicated to promoting the development of green finance. It actively implements the development strategy of green banking construction, provides legal and compliance support for the innovation of green financial products, promotes green and sustainable development related businesses, and assists the SPDB Hong Kong Branch in obtaining the Hong Kong Green Institution Certification.

How does the in-house legal team contribute to the overall dispute resolution strategy of the organisation?

The in-house legal team plays a critical role in developing and executing the dispute resolution strategy. The team is responsible for identifying potential disputes and assessing the risks associated with them. Additionally, we assess the risks associated with each potential conflict, including the financial and reputational risks. Once potential disputes have been identified with risks assessed, the team works with other departments to develop effective dispute resolution strategies. This may include negotiating with the other party, pursuing mediation or litigating the dispute in court. If the dispute cannot be resolved through negotiation or mediation, the team cooperates with external counsel to handle the case.
