Managing the risks connected with business transactions to enable management to make informed strategic choices is the mission of the NEC legal and compliance team in Spain. Led by Marina Bugallal, the NEC legal and compliance team is a multicultural team, which actively assist the business throughout decision-making processes, assessing and mitigating risks, fostering compliance with the applicable rules and reflecting the culture of the Japanese parent company, characterised by high ethical standards. The team is inspired by the willingness to balance compliance and business needs. ‘The NEC legal and compliance team designs and implements compliance policies aligned with general guidelines provided by the Japanese headquarter, without prejudice of the flexibility and the adaptability required by the local competitive business environment’, Marina Bugallal says. Taking advantage of its cultural diversity, the team has a multidisciplinary and business-oriented approach, which allows its counsel to assist several different business units, both in the private sector and in the public sector. Relevant examples, in this regard, are the legal advice provided for the implementation of the rules set forth by the General Data Protection Regulation (GDPR), alongside the legal advice provided to the business units in charge of the so called “Smart City” projects in Spain and Portugal. In particular, the first example clearly proves the NEC legal and compliance team’s ability to cope with new legal challenges posed by innovative cutting-edges technologies. Under the supervision of its data protection officer, Beatriz Ruiz-Beato, the team tackled issues connected with the application of data protection rules to new technologies in the IT sector. Regarding the second example, Marina Bugallal points out that, ‘the competitiveness of this new sector compels our team to cope with unprecedented legal challenges, such as the ones that we faced in the Smart City projects carried out in Santander and Lisbon’. In the light of the above, the legal department modernised its procedures, adopting new solutions able to improve the effectiveness of its day-to-day work. Furthermore, it improved its teamwork in order to share knowledge and have constant updates on the current situation of NEC’s business all over EMEA. The team focused on knowledge management tools, dedicating specific attention to the standardisation of internal procedures, according to the best standards of the market. The final goal is to provide clear and tangible results, coherently with the above-mentioned business-oriented approach and with the company’s culture overall.
