The legal team at Viatel & Digiweb Group has implemented a greater awareness of compliance and contractual risk management in recent years, in line with the needs of the telecommunications industry that they work within. Led by Kevin McNulty, group general counsel, the team consists of three lawyers, who specialise in legal regulatory and M&A, and two non-lawyers who are business analysts. Viatel & Digiweb is active in M&A, so working as a team they deal with the associated challenges of acquisitions, disposals or financing while still servicing the underlying business. As operators of data hosting and storage facilities, as well as communications providers, it has been essential that the legal team and the business understand the changes in industry regulation. ‘Evolutions in data protection legislation and practice affects all businesses. A data breach is the single biggest risk for many companies’, says McNulty. In addition the team has improved its technology and systems within the legal function, targeting consistency of advice, sharing of data between team members and improved ability to provide continuous service.
