What are the most significant private equity deals that you or your team have recently been involved in within the Latin American market?
In 2023, we were involved in the divestment of the Bolivian side of the Brazil-Bolivia natural gas pipeline; the signing of definitive transaction documents (including funds) for the acquisition of Ocyan, in addition to major refinancings of facilities and management of our existing portfolio.
Latin American markets vary widely in terms of economic stability and political dynamics. How do you factor these considerations into your legal strategies and recommendations for private equity clients?
It is a dynamic geography, so the main difference is constant monitoring of new precedents, regulations (which occur on a weekly basis) as well as, to the extent possible, built in the appropriate contractual framework in agreements.
What do you find most rewarding and challenging about working as an in-house lawyer specialising in private equity within the Latin American market?
A successful legal executive of an institutional investor needs to be a fully functioning member of the executive investment team, and who has the legal view of all situations and transactions. The intersection between the legal and business functions is one of the most rewarding features of the position.
