What are the most significant private equity deals that you or your team have recently been involved in within the Latin American market?
We have been involved in many private equity transactions among the year 2023. In particular, my team participated as legal advisors for twelve different transactions.
Latin American markets vary widely in terms of economic stability and political dynamics. How do you factor these considerations into your legal strategies and recommendations for private equity clients?
This is a constant challenge for all lawyers and advisors in the Latin American market. Political instability is mainly something that unfortunately always accompanies us, which is why we need to incorporate it as a characteristic when mitigating legal risks. Thus, we must be creative in keeping our clauses and contracts updated to be able to incorporate new risks that may arise. At Credicorp Capital we work across the Andean region, in that sense we have a significant exposure to political risk and very weakened economies. Therefore, we focus on foreseeing and mitigating risks and having exit clauses that guarantee our investments in bad scenarios.
What do you find most rewarding and challenging about working as an in-house lawyer specialising in private equity within the Latin American market?
The best thing about working in-house on these issues is having the possibility of being able to innovate and be creative in a constantly changing market that faces varied challenges.
