How do you approach managing legal aspects during periods of instability or crises, and how does your legal strategy align with the broader business strategy to ensure the organisation’s resilience?
The legal strategy needs to be in alignment with the business strategy, not only assessing but embracing the risk, with a proactive, resilient and pragmatic approach, facing the challenges one by one with a multidisciplinary team and a tailormade proposal of solution for each of the challenges and crises, there is not a one size fix all solution for all the crises you can face in an organisation and you need to keep open to learn from new experiences and adapt to different contexts.
What strategies do you employ to ensure the successful digital transformation of a legal department while maintaining compliance with Mexico’s data protection laws?
The use of digital tools is necessary to respond to the needs of the modern world in a more efficient way and at the speed required, however it can imply some data breach risks.
Some strategies that can be implemented to avoid this type of risks are: i) consider only the use of authorised tools by your IT team; ii) follow all the cybersecurity and data protection recommendations contained in the law and policies; ii) limit the amount and type of data shared (avoid the exchange of sensible data when possible); iii) restrict and define the length of the data retention; iv) ensure data owners authorisation of use; v) define which data needs to be encrypted before being shared.
These recommendations are not bullet proof but somehow help you reduce risks and protects your company if there is an authority challenge regarding a potential breach.
How do you prioritise diversity and inclusion within your legal department, and what initiatives have you implemented to foster a more inclusive and equitable work environment?
I prioritise diversity and inclusion in my team as it gives the opportunity to have different perspectives and build a stronger and high-performance team leveraging our differences, talents and backgrounds to have a wider scope and picture of things.
To foster an inclusive and equitable work environment, you must secure: an active participation of all the members in the team through dialogue, and make them lead the solutions and drive the changes they expect to happen, this only will happen if you achieve to have a safe environment where they can share their experiences, perspectives, and concerns.
