How do you approach managing legal aspects during periods of instability or crises, and how does your legal strategy align with the broader business strategy to ensure the organisation’s resilience?
One of the best approaches is to be proactive, ensuring that processes are in place for when crises occur. However, in times of significant instability, processes alone are often necessary but insufficient. Forming a SWAT team with top management and key players is crucial. This ensures that everyone involved during the crisis is aligned and can make decisions that balance immediate crisis management with evolving business strategies. The participation of the General Counsel is important during these periods, as their role involves both providing feedback on current issues and anticipating future challenges. This feedback and feed-forward mentality helps maintain alignment and adapt to shifting strategies, driving towards the same goal and ensuring the organisation’s resilience.
In your opinion, what are the main trends that are salient in your country currently (these can be legal, political, economy or business-based)?
Some of the most salient trends in our country currently revolve around the political and economic landscape. The nation is closely watching how the new executive power, particularly the cabinet, will be formed and the reforms the current government aims to implement before the transfer of power. One reform that has generated significant discussion is the proposed changes to the judicial system. Currently, federal judges in Mexico are appointed based on merit. The proposed reform seeks to have judges elected by popular vote, a stark departure from the current merit-based system. This potential shift in how judicial appointments are made is causing widespread debate and concern across various sectors.
