Depending on the level of complexity and revenue involved, Accenture has three legal teams working on the Latin American region based in Mexico. Its complex contracting team is responsible for the largest and more intricate matters in the region, while the transactional contracting team oversees transactions up to US$20m, and certain pre-defined complexity criteria transactions, while the global legal network, in Buenos Aires, Argentina offers offshore support to the rest of the client facing transactions of Accenture which take place in Hispanic Latin America. The legal contracting Hispanic Latin American team, based in Mexico, is made up of four top lawyers and led by Juan Luis Rodríguez-Rivero, director of legal services. He highlights that recently, ‘the most important challenge has been to keep up with the new technology trends and the regulatory changes and, in parallel, listening to our clients and the market. Mexico is updating a part of its legislation regarding technology (e.g. Mexican new Fintech Law)’. The team is working on new deals and solutions implying cybersecurity, machine learning, big data, could-based solutions, analytics and other innovations. It adds value by bringing knowledge of the industry, and a can-do attitude partnering with its clients’ counsel to bring a win-win situation for both companies and allowing Accenture to bring its best to its clients in a safe environment. He continues saying that, ‘we have changed our approach to negotiations to be advisors and guides for the legal counsel (in-house or outside counsel) of our clients so they fully understand the transaction we are making, how Accenture adds value to their client and the new trends of negotiations and/or negotiation positions regarding specific offering or specific issues (such as Mexican data privacy law or European GDPR implications and potential exposures to the international deal we are negotiating,) as well as the legal risks, exposures or, as mentioned, implied liabilities’.
