I joined Rash Peru as a Legal advisor in December 2009, where I had the opportunity to implement the legal area of the company from zero, while serving as corporate advisor of the group companies, with activities in the industrial, real estate, and commercial sectors.

In February 2015, I was promoted to legal manager. Since then, I have been involved in the advice, negotiation, and execution of the transfer of an important line of business of the company, which involved the transfer of the contractual position of more than twenty points of sale; this operation was successful and was carried out without any legal, labour or tax contingencies.

Additionally, we have overseen the incorporation of a subsidiary company in Bolivia, as well as the advice and support in all legal aspects related to the commercial operations in that country.

Moreover, I have been involved in the negotiation, subscription and implementation of the exclusive distribution agreement with the new owner of the RadioShack brand for Peru, after the RadioShack corporation filed for Chapter XI of the US Bankruptcy Law, transferring its assets and brands worldwide.

During the quarantine we were forced to close more than 150 shops nationwide, only being able to reactivate sales through the online channel after a few months. This meant a great personal and professional challenge, providing close and permanent advice to the general management team, board of directors and shareholders of the company, being an important ally in the development and implementation of action plans to address the serious health and economic crisis, in order to keep the company afloat in the long term; having to point out with great satisfaction that the objectives achieved at the end of 2020 exceeded even the expectations.

In addition to government restrictions, the implementation of Covid-19 prevention protocols in our shops, and constant labour inspections, we were subject to led to the initiation of disciplinary proceedings by the consumer Protection Authority (INDECOPI), which was ‘publicised’ by the media, generating harsh criticism toward the company, affecting its image and reputation. Faced with this, great teamwork was carried out, led by the legal management and with external advice, putting forward a solid defence before the entity, managing to lift the charges without economic sanctions for the company.

I certainly believe that the pandemic has highlighted the importance of the in-house lawyer (advisor, manager, or legal director) for business decision-making in times of crisis, being a key position for business continuity.
