How do you approach managing legal aspects during periods of instability or crises, and how does your legal strategy align with the broader business strategy to ensure the organisation’s resilience?

During periods of instability or crisis, the legal department must be even more dynamic, creative, and flexible to anticipate and propose solutions with these characteristics that make the business viable. A clear example of this occurred during the peak period of the COVID-19 pandemic, where the legal team addressed each and every issue to mitigate all contingencies while simultaneously ensuring that the business began to recover, always attentive first to the market reality and the needs of our clients.

The key factor during this process is to maintain open and fluid communication, ensuring that every new project or commercial challenge involves the legal team from the outset to avoid “rework”, thus finding the most agile and “ad-hoc” legal solution, thereby avoiding additional costs for its implementation.

What emerging technologies do you see as having the most significant impact on the legal profession in the near future, and how do you stay updated on these developments?

I believe that emerging technologies such as artificial intelligence, data analytics, and process automation will have a significant impact on the legal profession in the near future. Undoubtedly, the use of artificial intelligence, which is already a reality in all fields, has the greatest impact on the legal world. There are no limits to its use, as it will allow, for example, the reduction of time for drafting or reviewing contracts, and the creation, analysis, or comparison of legal strategies, among other capabilities.

This will equally challenge internal legal teams, as strategic thinking will have to be further developed in order to fully optimise the potential of AI. Moreover, the use of cloud platforms and blockchain technology can improve security and efficiency in managing contracts and legal transactions.

Notwithstanding the above, there are several questions being discussed worldwide in order to establish some criteria that allow for a regulatory framework in the face of the advancement of AI. I keep myself updated on all advancements in artificial intelligence through various forums, websites, and every social or professional network that provides information on the subject. It is worth noting that information is becoming increasingly accessible and easy to understand as the speed at which it progresses is impressive.

In your opinion, what are the main trends that are salient in your country currently?

The year 2024 is marked by the impacts that the “El Niño Phenomenon” could have on the Peruvian economy, specifically on agriculture, and therefore on job generation. In response, the government must be prepared not only to prevent and mitigate the impacts of the natural phenomenon on affected communities but also to establish legal measures aimed at mitigating its impact on the economy, especially on the financial system, which would be affected by the disruption of the payment chain. Additionally, the growing wave of crime sweeping the country should prompt the government to finally take the necessary measures to begin reducing levels of assaults, assassinations, and other crimes that affect the vast majority of cities in the country.
