How do you approach managing legal aspects during periods of instability or crises, and how does your legal strategy align with the broader business strategy to ensure the organisation’s resilience?
We have considered it essential to properly identify the legal risks your company faces, not only in times of crisis but also in the regular course of business, as there is no such thing as a “risk-free business.” Afterward, it is necessary to develop action plans either to be triggered when required or to be developed over time to exert the most control over the identified risks. This strategy should allow the company to be prepared when crises arise.
However, for all of this to be properly deployed, it is particularly important for in-house counsel to be deeply familiar with the business, its processes, and the daily concerns of management. This knowledge will allow them to identify risks and develop action plans.
What measures has your company taken to embed sustainability practices into its core business operations, and how does the role of the general counsel contribute to driving and ensuring sustainable practices within the company?
The general counsel role is one of the best suited to lead the ESG aspects of a company, as sustainability is no longer a “nice to have” but a “must have” in overall business strategy.
Not only are clients, investors, and customers requiring that the companies they work with have strong ESG practices, but there is also increasing regulation on the subject. From more demanding environmental regulations to diversity and inclusion requirements from non-environmental entities such as the SEC in the US or the UN, to supply chain due diligence and audited sustainability reports in the EU, the general counsel has the advantage of being able to understand and interpret the legal language of these new provisions. This allows the company to ensure compliance or develop action plans to meet forthcoming requirements.
At Camposol, we have an ESG strategy based on what we believe are the most relevant matters related to our business, such as carbon footprint reduction, relations with our communities, food waste, among others. As an agricultural company, we believe that our activity is inherently sustainable; however, this ESG strategy is going to help us reach the next level in the way we manage sustainability in our operations.
