How do you approach managing legal aspects during periods of instability or crises, and how does your legal strategy align with the broader business strategy to ensure the organisation’s resilience?

Managing legal aspects during instability or crises is challenging, particularly in developing countries. However, as legal counsel of CBC, we see it as an opportunity to demonstrate our energy, passion, creativity, and flexibility; to be part of the changes and see the challenges that arise during a crisis as a favourable time for growing and developing, since we must adapt overnight to counterintuitive ways of working.

Legal advice is always required, and we must adapt to new circumstances, setting aside our old ways of working to align the legal strategy with the broader business strategy. This ensures the organisation’s resilience by providing timely support in line with the current pace of business. We must take advantage of opportunities and quickly address threats while prioritising safety, taking into account that the world is advancing faster than ever, and speed in business is a key success factor. Companies must remain competitive and achieve profitable growth amid increasing turbulence and pressure.

We also ensure adherence to regulatory requirements in each market that we operate, with a focus on supporting CBC in its transformation process. This includes an open-minded attitude and way of thinking, always seeking opportunities to promote the business. We strive to incorporate additional knowledge and technologies to support our team members in achieving their professional and personal goals. We look to develop their strengths and help them work on their weaknesses.

What measures has your company taken to embed sustainability practices into its core business operations, and how does the role of the general counsel contribute to driving and ensuring sustainable practices within the company?

CBC Perú, as part of Grupo Mariposa, adheres to the United Nations Global Compact, which advocates for ten broad principles across four thematic areas: human rights, labour standards, environment, and anti-corruption. Environmental, social, and corporate governance (ESG) is a central focus for CBC. One ESG issue on our agenda is reducing our carbon footprint impact. Consequently, our factory in Huachipa, Lima, has obtained the certification “Zero Waste to Landfill” from Carbon Trust Assurance.

This certification recognises organisations that lead the way in waste management. Additionally, we contribute to organisations that support and train people in developing hydric resources in Peru; and have also created volunteering programmes to promote recycling.

The CBC legal team is committed to these goals. We assume the challenge of supporting the organisation from a legal perspective to create a legal structure that allows us to implement these goals. In this context, we have signed agreements with public and private entities to implement this structure and promote these programmes, especially for people who recycle. We have created an incentive where people earn points and then exchange them for products in many supermarkets nationwide.

In your opinion, what are the main trends that are salient in your country currently?

I think the primary trend currently salient in Peru is economic reactivation following the pandemic and the crisis that Peru faced in 2022. To accomplish this, we must create legal stability for investors to invest in the country.
