The 22 member legal team for Tecnológica de Alimentos (TASA) – the Peruvian leader in the fishing sector – is structured into different specialised areas; civil and corporate law, labour and procedural law, fishing regulation, licenses and environmental law and aquatic concessions. Each area has its own team of lawyers led by specialised professionals. ‘Teamwork is essential within our legal team, good communication between the different specialised areas of TASA’s legal team allows us to tackle issues and obtain answers with a multidisciplinary approach’ explains legal manager, Hortencia Rebeca Rozas Olivera. TASA’s legal team has been structured, in order to take into consideration the main core subjects of the business, ensuring that the operations of TASA are carried out in compliance with the relevant fishing regulations. Additionally, it has centralised all the issues that have an impact on the operation of the company in order to have adequate control and mitigate the company’s risks in a timely manner. TASA’s legal team recently closed a substantial number of administrative processes, eliminating a significant risk in sanctions, which entailed savings of approximately US$8m for the company. In addition, the team has been directly involved in two major arbitrations for the company, participating in all of its stages from collecting evidence, taking part in the hearings and drafting the arguments: ‘This has been important, since we consider that in-house legal counselling can provide a better input from the company’s point of view’, adds Olivera. Furthermore, the team participated in the structure of medium-term financing for around US$50m for the company. The legal team carries out operations by being strategic partners of the organisation, helping it comply with all relevant laws and regulations. ‘TASA is a company committed to carrying out its operations in compliance with the law and regulations, therefore, its legal counselling is always in accordance with the legislation, but also considering its impact in the company, its partners and the community’, says Olivera.
