Malcolm Montgomery’s wide involvement at a leadership level within Shearman & Sterling sees him head the firm’s real estate practice, real estate investment trust (REIT) affinity department and hospitality, leisure and gaming industry group. Montgomery assists clients with restructuring construction loans, mezzanine loans and credit facilities. His financings often involve multiple assets, multiple countries and multiple currencies. He has longstanding experience in Mexico, with leveraged loans for REITs a particular specialism of his practice. For example, Banamex and Citibank instructed him on a $500m loan to Terrafina FIBRA in connection with its $665m IPO, constituting the first-ever corporate revolving credit line for a FIBRA (a Mexican REIT-like structure). He has also advised Metropolitan Life Insurance on the development of a real estate-secured lending programme in Mexico, and the origination of over $1.8bn-worth of loans secured against Mexican resort hotels and industrial properties. A contributor to The Real Estate Finance Journal, Real Estate Finance and Pratt’s Journal of Bankruptcy Law, Montgomery has also written for the American Law Institute. He is a Fellow of the American College of Real Estate Lawyers, a member of the Real Estate Board of New York, and an advisory board member of the Northeast Chapter of the US-Mexico Chamber of Commerce.
