Part of Latham’s hugely impressive Mexico-focused private equity team, Thomas Malone has acted on a range of complex, cross-border corporate matters, advising private and public companies and private equity firms on M&A, joint ventures, carve-outs, investments and recapitalisations, and other corporate matters. A partner at the firm for nearly five years, Malone is frequently active on transactions involving Mexican pipelines. Key client Fermaca Global instructed a team including Malone on the $820m financing of its Northern Mexico pipeline, the first natural gas pipeline to obtain funding since new hydrocarbons legislation was passed by the Mexican government in 2017. In 2016, Malone was involved in advising Fermaca Global on the $425m financing of the 378km Villa de Reyes-Aguascalientes-Guadalajara pipeline, and on the $622m financing of the 450km La Laguna-Aguascalientes pipeline. In previous years, he advised Fermaca Global on the $858m development and financing of the 445km El Encino-La Laguna pipeline. On the M&A side, he assisted Fermaca Global and Ospraie Partners with the $722m sale of their controlling interest in Fermaca Luxembourg to Partners Group. Outside of Mexico, Malone acted for one Chilean energy and natural resources company on its joint venture with a global energy company to develop a solar power project. Malone also acts as outside legal counsel to the board of a healthcare services company and is a member of Latham’s initiatives committee.
