Over the past year Todd Alexander has represented both HSBC/CIBC and Nomura as lenders to a gas-fired power plant and a solar plant, respectively. He also represented a private equity investor in connection with the acquisition of a 50% interest in three wind farms. Alexander has also notably represented private equity lenders to a majority owner of an LNG facility; and also representing OPIC as lender to Vista, a Mexican E&P company. Also of note, Alexander hosts one of the leading energy podcasts, called “Currents”. It can be found at projectfinance.law or podcast forums. Previous discussions concern the Mexican energy sector including management from the North American Development Bank.

What differentiates your Mexico-facing practice from those of your US competitors and peers?

We are one of the few firms who have offices in both the US and Mexico, which allows us to handle both New York law and Mexico law portions of a financing within the same group. We also have a team of attorneys in the US and Mexico with expertise in both power and oil and gas. Finally, we have experience on both the sponsor and lender side.

What are the advantages and disadvantages of advising Mexico-based clients from an office in the United States?

Both offices are able to handle the representation of clients in the US. We try to use the most efficient staffing. Typically, we would use a US based team where the client is based in the US or the documents are governed by New York law.

What changes in the commercial and/or legal market do you anticipate in the 12 months ahead in Mexico?

Given the change in government, this is difficult for anyone to predict. I certainly am not in the best position to answer this.

What influence will legal technology have on US/Mexico working practices in the future?

Our offices are already the same on a virtual basis within Norton Rose.

What is your perception of in-house counsel’s priorities in terms of client service when working with US-based law firms?

The demands of Mexican clients are similar to those in other jurisdictions. Everyone expects expert advice, responsiveness, and appropriate fees. One difference between US and Mexican clients is that Mexican clients tend to utilize in-person meetings more frequently.
