What steps do you take to ensure effective communication and collaboration with external counsel and other stakeholders during the dispute resolution process?
The first meeting is crucial to setting the tone and strategy of the dispute. We ensure that we are fully prepared for the first interaction between external counsel and stakeholders. Our goal is to have a timeline prepared and provide all supporting documents prior to the first meeting. We also lead these meetings by pinpointing the pertinent clauses within that large collection of documents, ensuring that external counsel can swiftly catch up. This results in significant time and cost savings, as external counsel can promptly offer insights on the legal stance and potential legal outcomes without spending too much time on the matter. Those lawyers who are proficient in these matters are likely to quickly leverage their expertise to provide initial guidance from the outset. Furthermore, this helps us in identifying the most suitable counsel for the specific case.
How does the in-house legal team contribute to the overall dispute resolution strategy of the organisation?
Our approach is always to give our best effort from the onset and avoiding unnecessary prolonging or escalation of an issue. When confronted with a potential claim, our focus is delivering a swift response. This may involve senior management communicating with the claimant to assure them of our proactive investigation and providing a timeline for our response. It could also encompass gathering information from multiple stakeholders, engaging external counsel, and conducting a thorough legal analysis. This approach helps to provide the claimant with a sense of comfort regarding our commitment to resolving the issue and establishes a foundation of good faith, should the situation eventually escalate before the judiciary.
We believe in delivering a comprehensive first response. While some may argue that as issues grow in complexity, legal resources should increase accordingly, our strategy takes a different approach. We prioritise leveraging any opportunities for commercial negotiation from the outset. Whether we accept or reject a claim, we are committed to establishing our position with complete facts and sincerity.
