Countries in Latam your role covers: Chile, Brasil, Perú, Colombia and México are the main ones where we develop high level of projects and tenders; however we carry out many development activities also in Guatemala, Costa Rica, Ecuador.
What are the most significant cases and transactions in the LATAM region that you or your legal team has recently been involved in?
The most relevant achievement not only in Brazil but also in the region is the just closed senior financing of the metro Line 6 of Sâo Paulo. This is the largest PPP infrastructure project under execution in Brazil and the whole Latin America. We have implemented the first ever international project finance structure in Brazil for a project of this kind. The project is valued at about $3.5b. I have led this financing transaction from the in-house legal perspective, which has entailed one of the most complex financing transactions I have ever been involved in. Aside many other tenders and projects we have been involved in, I would like to highlight the formation of the South America Legal Department of ACCIONA Energía (which I left in 2020 after 12 years, to join ACCIONA Concesiones and become the Global Head of Legal for this business). I moved to Chile in 2014 and remained there until 2020, forming and leaving a great local legal team for the Region.
The unusual business environment created by the pandemic has been swiftly followed by the Ukraine crisis, attendant supply chain costs rising and inflation. Are you now putting more emphasis on preparing for the unforeseen and, if so, what does this entail?
We have put more focus on events related to pandemic and similar unforeseen scenarios which could materially impact the ability to perform the obligations under the concession, construction, O&M or financing agreements. Force majeure and relief events are of high importance after the experience undergone after the Covid-19 pandemic. Ukraine war, supply chain issues and inflation impacts are more related with a financial standpoint when approaching each tender and transaction.
What are your organisations plans in the LATAM region over the next 12 months and how will your legal expertise help to achieve these plans?
We plan to continue our strong tendering and M&A activity in different sectors in alignment with our company strategy.
