What are the most significant cases or transactions in the Latam region that you or your legal team has recently been involved in?
We have been deeply involved in all negotiations to reach a deal with financial creditors regarding PPP Proyecto in Uruguay. Additionally, we have been part of arbitration proceedings against public employers, in relation to the execution and development of construction projects in Peru and assigned construction contracts in Colombia. Furthermore, we have litigated in against public employers in Colombia seeking liquidated damages for delay in ascertain projects, as well as setting up branches and affiliates.
The unusual business environment created by the pandemic has been swiftly followed by the Ukraine crisis, attendant supply chain costs rising and inflation. Are you now putting more emphasis on preparing for the unforeseen and, if so, what does this entail?
We have already worked in that kind of condition, but maybe no work in more detail on unforeseeable risk clauses, to provide clear proposals to clients regarding shared risks in the event of uncertain circumstances, renegotiating contracts with subcontractors.
What are your organisations plans in the Latam region over the next 12 months and how will your legal expertise help to achieve these plans?
Alliances with local companies to grow in ascertain countries, obtain concession contracts, consolidate our position in Colombia, all in order to reinforce our presence in Latin America.
