How do you see the general counsel role evolving in Thailand over the next five-ten years?
Thai general counsel are no longer just the “local” counsel where businesses seek advice on Thai law perspectives only. We are fully capable of managing and assisting businesses in growing in new markets and jurisdictions beyond Thailand. Today’s economy is borderless, and we play a pivotal role in navigating complex compliance landscapes, especially with the rise of digital transformation.
In the future, we will likely see a greater emphasis on risk management, data privacy, and cybersecurity. Additionally, we will take on more proactive roles in corporate governance, sustainability initiatives, and fostering ethical business practices, aligning legal strategy with overall business objectives.
In the next five-ten years, I am sure we will see more Thai lawyers taking on the role of managing counsel or general counsel for SEA, APAC, and global positions.
Which recent political, economic or regulatory changes have impacted your work the most in recent years?
As activities increasingly shift online, Thai lawmakers have been quite proactive in responding to these socio-economic changes. Recognising the need to regulate digital services and protect consumer rights, they have implemented and discussed several key legislative measures.
Most notably, the implementation of the Personal Data Protection Act (PDPA) has brought about significant changes to business operations handling of personal information. Additionally, the Royal Decree on the Operation of Digital Platforms requires businesses falling under its scope to take the necessary actions to ensure compliance. Furthermore, there has been recent discussion on the draft “Lemon Law,” which aims to protect consumers from defective products, ensuring they receive fair treatment and adequate recourse. These initiatives are all part of a broader effort to enhance trust in online transactions and require general counsel to be more agile, informed, and proactive in ensuring regulatory compliance, managing risks, and providing strategic advice in this fast-paced environment.
Are the effects of AI on the legal world overplayed, or underplayed?
The effects of AI on the legal world are neither overplayed nor underplayed; rather, they represent a transformative shift that is still unfolding. AI has the potential to revolutionise various aspects of legal work, from document review and legal research to contract management, offering significant efficiencies and cost savings. However, the human element will always remain crucial for providing well-founded legal judgment and ensuring that ethical considerations are preserved. Personally, I am excited to see AI’s potential to transform and enhance practices within the legal profession.
