What are the most significant cases and transactions that your legal team has recently been involved in?

In 2021, One Mount Group hired a consultant to build a data privacy framework for the group, including the parent company and its subsidiaries, but it did not meet expectations.

I and a several people in the legal team along with the data department not only built a data privacy policy but also built a new data management system for the entire group, a project that if outsourced would have cost more than US$2million. This framework ensures compliance with Vietnamese law and international practices, such as GDPR and PDPA. It also realises the purpose of maximising the value of the company; as the foundation for establishing our people-process system.

Could you share an example of a time when you came up with an innovation that improved how your legal team works and did not come at a large expense?

We have built an electronic contract management system and established a customer consent storage centre. We have implemented the system to assist with initiating and operating electronic contracts to serve the business and the operational activities of enterprises.

How do you see the general counsel role evolving in Vietnam over the next five-ten years?

Businesses that want to make sustainable breakthrough developments need their general counsel to serve as solid legal support as well as a business partner with effective solutions. Therefore, the general counsel’s role in the next five to ten years will be very important in the business, working side by side with shareholders and business owners.

What are some of the main trends impacting your industry in Vietnam?

This industry will need many lawyers who possess strong and diverse expertise, an understanding of technology and finance, and who are knowledgeable about business models and strategies to better accompany their businesses. Lawyers who only understand the law are not enough.
