Advised a local authority on options to act as a Biodiversity Net Gain Habitat Bank, having regard to the limitations imposed by the legislation which do not allow Local Authorities, in their capacity as landowners, to enter into planning agreements with themselves.

Provided strategic advice to a local authority in respect of the proposed demolition of the City’s sole high-rise apartment block and redevelopment of the site, including relocation strategy, negotiations, and potential use of CPO powers.

Advised a local authority on the delivery of the Oxford Street Bus Priority Package Scheme, a traffic scheme which restricts access to vehicles other than buses, bicycles and taxis and which enforces against any traffic contradictions, including advice on enforcing the scheme and the lawful issue of traffic penalty notices against any breaches.

Drafting a protocol for the use of s203 Housing and Planning Act for a local authority to streamline and strengthen the procedure for appropriating land to planning purposes, providing a robust basis for decision making and shifting the burden of evidence-gathering to the developer.

Advised a local authority on the delivery of the Aviva Studios (home of Factory International), in drafting and completing a tripartite agreement between Manchester City Council (MCC), Salford City Council (SCC) and National Rail (NR), in relation to the historic NR’s land, which was necessary for the delivery of the project.

Advised a local authority in respect of the creation of a new community at Bayswater comprising 1,450 new homes and 120 assisted living homes with associated infrastructure.

Negotiated a suite of highway agreements on behalf of a local authority to facilitate the £500m expansion of Shepperton Studios, whilst ensuring that the multiple and complex road improvements required were appropriately managed and phased to ensure minimal disruption to the users of the highway.

Advised a local authority on the pedestrianisation of Albert Square, in the historic city centre and in the curtilage of the listed Town Hall building. The project involved the stopping up of highways and advice on ownership of the land no longer being a highway (ad medium filum presumption).

Advised a local authority on the use of Housing Act 1985 CPO powers as part of its Empty Homes Strategy.

Acted on behalf of a local authority to settle a claim from a business premises which had threatened judicial review following the grant of planning permission for 160 homes.

Advised a local authority on template highway agreements (under s278 and 38 of the Highway Act 1980), processes and forms to streamline and expedite the procedures followed by the highway and legal officers to improve the Council’s service.

Advised a local authority in protecting a 53-hectare greenfield site from development, including successfully defending the decision to refuse two planning applications for up to 600 residential units and a marina at a 4-week public inquiry and at subsequent High Court and Court of Appeal proceedings, and via the emerging Local Plan.

Advised a local authority in respect of a complex and controversial joint development plan document. This raised many novel issues, including the late withdrawal of one of the districts from the plan and substantial changes in Government policy immediately prior to publication, where timely and accurate advice on often untested areas of law and the NPPF is of the essence.

Advised a local authority on the Angel Street CPO, to facilitate the widening of Angel Street which in turn would facilitate the delivery of the Co-Op Headquarters and the Hyde Road CPO, to widen Hyde Road (A57) and demolish the existing railway bridge, which would be replaced by a bigger bridge to carry a cycleway.

Advised a local authority on the interpretation of the expert’s dispute clause, which is frequently used in s106 agreements, which case related to a housing scheme in Winnigton Village for the delivery of up to 1000 houses. The Council, acting on Chrisa’s advice, represented its case in the High Court and the Court of Appeal, and won.

Advised a local authority on the planning appeals relating to two CLEUD applications and decisions as well as the service of enforcement notices against the Chester University and the unauthorised change of use of the premises in Thornton Industrial Area in Ellesmere Port from industrial to learning and non- residential institution uses. The Council won the appeals.

Advised a local authority on a pre-action letter and Judicial Review against the Council’s decision to discharge a planning condition attached to a planning permission relevant to the odour management system of a farm in Northwich (R. (on the application of Cathie) v Cheshire West and Chester BC, [2022]EWHC 2148 (Admin).

Advising a government body  in respect of a £26million compulsory purchase compensation claim arising from the acquisition of land to facilitate the £1.5 billion A14 Cambridge to Huntingdon improvement scheme.

Our team of planning specialists are able to advise on all planning, highways, compulsory purchase and planning litigation matters.  This includes, but is not limited to: s106 agreements, strategic planning advice, listed buildings, appeals, enforcement, judicial review and statutory challenges, highway agreements, rights of way, stopping up, traffic regulation orders, promoting and objecting to compulsory purchase orders and development consent orders, and compensation claims in the Upper Tribunal.

All members of the team are at least 16 years qualified and have joined Davitt Jones Bould from senior in-house roles or city firms. The planning specialists are supported by the whole legal team of over 70 lawyers who have an average of 25 years’ PQE.
