Tax Advice – Direct Tax and VAT
Corporate clients
DSM’s Tax team advises corporate clients on a wide range of international transactions, investment structures as well as on day-to-day business matters involving Luxembourg. It not only represents Luxembourg companies, shareholders and lenders but also borrowers, collateral providers and pledgees. In particular, DSM’s Tax team provides tax advice to alternative investment funds (including FIAR, SIFs, SICARs and securitization vehicles), private equity houses, banking institutions as well as industrial and commercial groups. All tax fields are covered, including, inter alia, corporate income tax, municipal business tax, net wealth tax, VAT and other particular taxes or registration duties. Moreover, we cover the full range of tax advisory services from strategic tax planning to high-end technical advice.
Private wealth
DSM also advises on private wealth management and private wealth vehicles, such as family wealth management companies (SPFs), Luxembourg Limited Partnership (SCS), Luxembourg Limited Partnership special (SCSp), family offices and private foundations. Furthermore, DSM has specific expertise in tax planning and managing international successions, inheritances and gift taxes. DSM’s Tax team also has in-depth expertise in personal tax and social security matters.
Tax authorities and litigation
DSM’s Tax team has significant experience interacting with the Luxembourg tax authorities in local and cross-border matters at any pre-litigation phase. Moreover, DSM has a strong local and international tax litigation practice, covering direct taxes and VAT, and represents its clients before all Luxembourg and EU courts. DSM also assists its clients within the context of cross-border administrative procedures for the elimination of double taxation situations.
Tax compliance
DSM’s tax team also assists its clients in the establishment, review and follow-up of their tax compliance documents regarding direct taxes and VAT.
Tax disputes resolution
As the international tax environment has experienced drastic changes over the last few years, serving clients in tax matters includes not only a tax advisory component but also, increasingly, tax dispute resolution.
