Emma is a partner in the dispute resolution team, advising on all types of commercial disputes with a particular focus on property litigation, commercial agency disputes, product liability and public procurement. Recognised as a “Next Generation Partner” by Legal 500 2023. Emma regularly represents clients on resolving disputes through alternative methods such as mediation. Experience Property Litigation Emma works closely with the firm’s commercial real estate team in dealing with landlord and tenant disputes, including contested lease renewals, dilapidations claims, forfeiture and service charge disputes. She also advises landlords on their obligations in relation to their residential property portfolios, including on rights of first refusal, leasehold enfranchisement and right to manage. Commercial Agency Emma advises both commercial agents and principals on their rights and obligations under the Commercial Agents (Council Directive) Regulations 1993. She regularly writes articles on this area for AgentBase, a trade organisation for commercial agents. Procurement Emma acts for suppliers in challenging tender awards under the Public Contracts Regulations 2015 and other associated legislation. Emma frequently achieves strong outcomes for clients including obtaining damages awards, re-runs of tenders, and the addition of parties to framework agreements. Emma gives regular webinars and training in this area Product liability Emma has expertise in product liability matters in particular for clients in the automotive sector. Emma advises manufacturers and suppliers on claims brought in negligence and under the Consumer Protection Act 1987, as well as on regulatory responsibilities including product recall.

Will is a Partner specialising in data protection advice, both contentious and non-contentious. Will advises a range of clients from large multi-nationals looking to ensure that their UK/EU operations are compliant with the requirements of GDPR while integrating with their worldwide activities, through to start ups particularly working in the deep tech fields like AI, facial recognition and big data applications.   As a nationally recognised expert on GDPR and data protection matters, Will has established a broad practice servicing clients across the UK, as well as having considerable experience in advising clients based in the US/Canada and in the Far East. He provides strategic advice to help clients to build products and services around the concepts of data protection by design, supports clients with their transformation or compliance audit activities, and represents clients in contentious matters up to and including at Court in appropriate circumstances.   Will’s broader disputes work encompasses a range of commercial technology disputes. Stephen is the Head of Dispute Resolution. He has a wealth of experience dealing with complex commercial disputes in the High court and in particular the Business and Property Courts. He acts for a variety of UK and international companies as well as high net worth individuals with cases encompassing areas such as technology sector disputes, product liability claims, intellectual property, breach of trust, corporate and shareholder disputes and injunctive relief. Stephen’s approach is to gain an understanding of the client’s business and the underlying issues facing the products or services involved in the dispute and the client’s key drivers as this is equally as important as the legal issues in play. Stephen is a member of the Society for Computers and Law and is a CEDR qualified mediator.

Tom Maple

Tom is a Partner in the Dispute Resolution and Litigation team. Tom specialises in commercial dispute resolution and is experienced in advising commercial clients in a broad range of industry sectors. Tom has particular expertise in the Automotive and FMCG Sectors, and heads up our automotive team. Tom’s clients include international vehicle manufacturers, international suppliers to national supermarket chains, national parts suppliers, national and national and international produce suppliers and fleet hire companies. Since the introduction of the Groceries Supply Code of Practice (GSCOP), Tom has advised a number of clients of their rights against retailers under GSCOP as well as advising on the enforceability of contractual terms regularly used by retailers in supply agreements. Tom is also in the privileged position of taking a case to arbitration under the Dispute Resolution procedure available to suppliers in the event that a retailer breaches their rights under GSCOP. As well as advising his automotive clients on a variety of legal issues, Tom regularly gives training to his automotive clients on how to manage risk and resolve disputes (Tom has recently advised on matters pertaining to the changes to the law of termination in light of the Covid-19 pandemic). Tom’s broader commercial litigation practice involves advising on breach of warranty claims, s. 994 minority shareholder claims, partnership disputes, breach of contract and negligence claims. Tom’s recent cases include: Acting for a large supplier in a multi million pound arbitration under GSCOP. Advising an international vehicle manufacturer on a c. £2m breach of contract claim under a sponsorship agreement. Defending on a £20m breach of warranty claim brought by a Canadian venture capital fund. Advising a recycling company and its insurer client in a multi million pound negligence claim. Tom began his legal career at Lawrence Graham in London and joined FSP in 2013 from Henmans LLP in Oxford.

Rowan is also the head of the firm's construction service.  She arranges and delivers a highly successful series of seminars on construction-related topics. Rowan is experienced in dealing with substantial claims in the High Court and County Court and has resolved a number of cases through mediation and adjudication. She provides practical and commercial advice to her clients who appreciate her calm approach to the issues they face.
