Career

Rafael is counsel at the firm and has broad experience in regulatory consulting, strategic legal protection, and litigation, including constitutional litigation as well as advisory in highly regulated sectors such as banking and highway infrastructure. He regularly represents and counsels leading financial institutions –private banks and development banks, telecom, and infrastructure companies, among others, across a myriad of regulatory matters.

Rafael’s solid experience in constitutional and administrative litigation includes working both for the private sector before administrative authorities, as well as the public sector, allowing him to provide comprehensive advice in his areas of practice. He also has expertise with cases before the Mexican Supreme Court that have resulted in ground-breaking constitutional and regulatory judicial precedents. This includes representing a financial institution regarding the validity of the parametric model used to analyze the solvency and viability of payments of its borrowers, for which a favorable ruling was obtained impacting the financial system. Similarly, Rafael was part of the team obtaining a favorable ruling for a telecom concessionaire, sorting out the unconstitutionality of Mexico’s Telecommunications Law that established disproportionate fines based in gross incomes. He also advised COFECE, Mexico’s Federal Antitrust regulator as autonomous constitutional body in the filing of a Constitutional Controversy Remedy (Controversia Constitucional) challenging the law setting out irrational limitations to the remunerations for the public servants below the wage of the Mexican President.

Rafael holds a master’s degree in Economic Law from Universidad Panamericana and a law degree (JD equivalent) with honors from Escuela Libre de Derecho in Mexico City.
