According to the license agreement signed with the inventors in 2015, defendant received the exclusive right on the territory of Ukraine to produce haemostatic agents that were purchased by military hospitals for the needs of the Ukrainian army. However, despite the successful implementation of that right, no royalties were paid to the inventors of the unique technology.

Sayenko Kharenko’s team defended the interests of the scientists-authors of the crucial invention for the country given the modern conditions in the courts of first instance and appeal. As a result, Sayenko Kharenko’s attorneys-at-law defended the rights of Ukrainian inventors to receive royalties for the use of the intellectual property rights belonging to them.

On 21 December 2020, the court of appeal put an end to the case, leaving the decision of the court of first instance in favor of Ukrainian inventors unchanged.

Partner Yaroslav Ognevyuk comments on the successful completion of the project: “Our team has many similar successful projects in its portfolio, but I am especially happy to have won this case. Given the fact that it is hardly possible to overestimate the importance of our clients’ invention since this is about saving a large number of human lives.”

Associate and attorney-at-law Tetiana Yushchenko worked on the project with the strategic support of partner and attorney-at-law Yaroslav Ognevyuk.
