Position

Değer is the founding partner of the Boden Law. She has significant experience in energy, infrastructure and arbitration matters. She is listed in various ranking as a leading individual for her energy and natural resources’ practices.

She has extensive experience working on project development and finance transactions in the areas of power, telecommunications, oil and gas, ports, metals & mining and general infrastructure. 

Career

Değer has a very unique energy practice in Turkey; she has been involved in many different aspects of the Turkish energy sector. Her expertise in the sector embraces commodity trade transactions, mergers and acquisitions including asset and stock acquisitions, turn-key EPC contracts, EPC+F contracts, project finance transactions, privatizations, public service contracts and concession agreements.

She assists clients in avoiding or resolving disputes and regulatory issues (including energy regulations) through negotiation, mediation, arbitration and litigation. Her experience embraces international commercial and investment treaty arbitration. She also advises clients in relation to the structuring of their overseas investments to benefit from investment treaty protection. Her commercial arbitration experience includes disputes arising from shareholders agreements, construction agreements and EPC contracts. She also represents clients in enforcement proceedings.  She was a member of the team in representation of the Republic of Turkey in the very first ICSID arbitration case pursued against the Republic of Turkey. The case was regarding a power plant project based on BOT model and against the abrogation of treasury guaranties and long term power purchase agreements. She also acts as an arbitrator in disputes arising from energy contracts including EPC Contracts.

She takes an active role in the society for environment protection. She largely lectures and speaks on climate change and sustainability matters. She is a member of the Advisory Board of the Center for Energy and Sustainable Development (CESD) of Kadir Has University. She is also a Board Member in the Carbon Footprint and Sustainability Association.

She publishes, teaches and speaks extensively on arbitration and energy matters. She is Chair of the Energy Commission of Istanbul Arbitration Center (ISTAC).
