Dispute resolution precedents: EQUITY’s team has acted for clients in two landmark cases in the Supreme Court of Ukraine which resulted in new precedents in insolvency matters.

In one case, the Supreme Court upheld EQUITY’s reasoning and ruled that the court may not adopt a formalistic approach in assessing the facts and taking a decision on the commencement of the insolvency proceedings.

In another case, the Supreme Court upheld EQUITY’s reasoning and confirmed that the central bank had unlawfully declared one of Ukrainian banks insolvent.

In 2023, Oleksandr Lysak and Taras Poshyvanuyk obtained acquittals in the Supreme Court of Ukraine. This has proved the firm’s outstanding experience in white-collar crime matters, given that acquittals constitute only 1% of the decisions in criminal proceedings.
