Career

Marco Martinelli is an expert in administrative law, particularly in public economic law.

He has gained extensive experience in administrative litigation, providing judicial assistance before the Regional Administrative Courts, the Council of State, and the Court of Cassation, as well as before European judicial authorities in all areas of administrative law. His expertise particularly covers public contracts (procurements, concessions, and Public-Private Partnerships), strategic infrastructure of national importance, services of general economic interest, public entity finance, project financing, energy, urban planning, construction, publicly owned companies under the Unified Text on Public Companies (T.U.S.P.) as per Legislative Decree 175/16, procedures for granting public financial aid, and proceedings before independent and regulatory authorities (AGCM, AGCOM, ANAC, ARERA, Transport Authority, CONSOB, and the Bank of Italy).

Additionally, he assesses public law aspects in corporate acquisition, merger, and sale procedures, as well as in privatization processes of public companies and the disposal of public assets. He has also developed significant experience in matters related to so-called "golden power," distortive foreign subsidies under EU Regulation 2022/2560, and administrative liability before the Court of Auditors.

He graduated with honors in Law from the University of “La Sapienza” in Rome in 2000 and obtained a PhD in Administrative Law from the Department of European Law at the Faculty of Law of the University of Roma Tre in May 2006.

Since 2003, he has been a lecturer at the National School of Administration as a recognized expert. He is also an adjunct professor at the Guglielmo Marconi University and teaches in some of the most prestigious second-level Master’s programs in administrative law. Previously, he taught at the School of Specialization for Legal Professions at the University of La Sapienza, covering administrative law and administrative justice. He regularly participates as a speaker in numerous training courses organized by Paradigma S.r.l. and sector conferences.

He has authored numerous articles, essays, and case notes on public procurement, state aid, cultural heritage, public services, and administrative justice. He is a member of the Administrative Law Advisory Committee of the Rome Bar Association and has been qualified to practice before higher courts since 2015.

He joined LEXIA in January 2025 after practicing law at leading law firms.
