India jumps to sixth position in patent filings

Worldwide intellectual property registrations in 2021 have shown an increase over the previous years. 3.4 million patent applications have been received by various patent offices around the world, out of which more than one-third have been received by the local patent offices of China. Receiving 1.59 million patent applications, China registered an increase of 5.5% over the previous year. USA was a distant second with 591,473, followed by Japan (289200), Republic of Korea (237998) and EPO (188788). Leap frogging of China is highlighted by the fact that if the filings of 2nd to 13th country are added up, they match up to the filings of China.

Pct third party observations

World Intellectual Property Organization (WIPO) introduced Third Party Observations Service (TPOS) (under section 801(a), 804(b)) on April 13, 2017. This service allows third parties to make observations through the ePCT system (i.e., by accessing ePCT designated offices (DO) function) by citing prior art(s) which they believe to be relevant to the question of whether the invention claimed in the international application is novel and/or involves an inventive step.

For others, a tattoo is just a style statement without a deeper meaning associated to it. As a result, the tattoo business is blooming and several people with appreciable artistic talent are assuming the roles of tattoo artists.

Litigants do not have to go to courts; courts will come to the litigants

On Tuesday 5th of July 2022, the Hon’ble Delhi High Court directed creation of 42 new Commercial Courts in the National Capital within six months, to expedite the speedy disposal of commercial disputes. The Court issued the directions while hearing a Public Interest Litigation (PIL) which stated that the 42 new Commercial Courts which were notified and/or sanctioned by the Delhi Government on April 13, 2021 were not setup.

In the matter of Concrete Additives and Chemicals Pvt. Ltd v. S N Engineering Services Pvt. Ltd, the Bombay High Court dealt with an application filed under the Arbitration and Conciliation Act, 1996 (the Act) whereby Concrete Additives and Chemicals Pvt. Ltd (Concrete) had prayed for appointment of an arbitral tribunal to adjudicate the dispute which had arisen under the purchase orders that were issued by S N Engineering Services Pvt. Ltd (SN).

The high court of delhi rules governing patent suits, 2022

Provisions regarding patent suits are governed by the Patents Act 1970, hereinafter called the Act. They are also governed by the Code of Civil Procedure, 1908 (CPC) as amended by the Commercial Court Act, 2015. The High Court of Delhi is also empowered to make rules regarding procedures for Civil Suits and patent suits. The High Court of Delhi Rules Governing Patent Suits, 2022 were issued through a gazette notification on February 24, 2022. The Rules are in addition to CPC as amended by Commercial Courts Act, 2015, and also the Indian Evidence Act 1872.

The movie, though based on the life of an acid attack survivor – Laxmi Agarwal, received multiple inputs from Laxmi Agarwal’s real life lawyer – Adv. Aparna Bhat.

Not all computer related inventions are non-patentable!

In 2002, Ferid Allani (“Allani”) filed a patent application (IN/PCT/2002/00705/DEL) for his computer related invention titled, “method and device for accessing information sources and services on the web”. As per the Complete Specification, “the invention proposes a method for accessing information sources and services on the Web, that is quicker and easier to use than the present methods for accessing information on internet, notably with an objective of integration within interactive terminals and office automation and communication equipment.” The Indian Patent Office rejected this application stating that it lacked novelty and was hit by the provisions of Section 3 (k) of the Indian Patents Act.
