S&A Law Offices successfully represented Shrishti Infrastructure Development Corporation against the Airport Authority of India

S&A Law Offices acted for Shrishti Infrastructure Development Corporation Ltd (“SIDCL”) wherein SIDCL had challenged the order passed by the Airport Authority of India (AAI) rejecting the grant of permissible height for SIDCL’s building structure under Section 9A of the Aircraft Act, 1934 read with Ministry of Civil Aviation (Height Restriction for Safeguarding of Aircraft Operations) Rules, 2015. SIDCL argued that the height restriction was based on a "crude method" without proper mathematical or computer modelling and that the decision lacked valid reasons. Additionally, it contended that the permissible height should consider the tilt angle of the radar and that the site should be assessed under multi-radar criteria due to the presence of more than one radar at Kolkata Airport. AAI countered that the height restriction was scientifically calculated using the NOCAS system and that the multi-radar criteria did not apply as Kolkata Airport only had one ASR radar. The Hon’ble Delhi High Court, in its judgement dated 15 October 2024, quashed the Order passed by the AAI, citing that the said order was cryptic, passed without assigning any reason and was in violation of the principles of natural justice. Challenging the said Order of debarment, DBL approached the Delhi High Court by filing a Writ Petition.

The SC dismissed the SLP on the ground of the analysis of the documents on record and found no reason to interfere with the impugned order passed by the High Court.

WHHPL v NHAI

New Delhi, 31st August 2019: West Haryana Highways Projects Private Limited (a Special Purpose Vehicle of Era Infra Engineering) was awarded a Concession Agreement by NHAI on DBFOT Toll basis for widening of existing two lane highway and also constructions of two new bypasses. Although WHHPPL substantially completed the work and Toll was stared in 2014, NHAI was not declaring the completion. Also WHHPPL suffered huge losses due to Project overrun including threat from Banks/Financial Institution w.r.t Insolvency Proceedings (needless to reiterate one such proceedings under I&B Code filed by Bank of Baroda (erstwhile Dena bank) was recently rejected by Principal Bench, New Delhi). It was the case of WHHPPL that NHAI failed to adhere to the terms of CA in fulfilling its obligation of handing over of land. The Arbitral Tribunal passed an Award in favor of WHHPPL inter alia agreeing with the contentions of WHHPPL and also held that NHAI was in breach of the CA. The Tribunal passed an award (including interest) of Rs.750 Crores in favor of WHHPPL.

Division Bench Of Delhi High Court Upholds The Single Judge’s Judgment

DIVISION BENCH OF DELHI HIGH COURT UPHOLDS THE SINGLE JUDGE’S JUDGMENT UPHOLDING THE ARBITRAL AWARD IN FAVOUR OF PNC-BEL (JV) AGAINST NHAI To map the progress of Indian Courts in arbitration matter, a perfect example is the PNC-BEL matter, wherein the Delhi High Court has not only decided the Application filed by NHAI under section 34 and Appeal thereof under section 37 of the Arbitration and Conciliation Act, 1996, but also releases the entire amount of around Rs.143 Crores to Concessionaire around 10 months of the passing of the Award. In this regard, the Award was pronounced by the Arbitral Tribunal on 20.09.2018, the section 34 Objection was decided on 24.05.2019 and the Appeal under section 37 was decided on 26.07.2019 and finally the money has been received by Concessionaire on 30.07.2019.

Delhi High Court Rejects The Objection Of Nhai Against The Arbitral Award Regarding Pnc-bel (jv)

The Hon’ble Delhi High Court rejects the objections of NHAI under section 34 of the Arbitration and Conciliation Act, 1996 regarding an Arbitral Award which was passed in favour of PNC-BEL (JV). The petition [O.M.P. (COMM) 41/2019, decided on 24th May, 2019] was filed by NHAI challenging the Arbitral Award dated 20.09.2018 passed by the Arbitral Tribunal adjudicating the disputes that have arisen between PNC-BEL (JV) and NHAI in relation to the Agreement dated 04.02.2005, executed between the parties for the Project for Widening and Strengthening of National Highway No. 24 from Km 93.00 to Km 149.25 to four lane standards (Garhmukteshwar to Moradabad) & ROB at Km 181 of NH-24 and Bridges on NH-87 in Uttar Pradesh (Package-II).
