Deutsche Bank AG (Bank) vs. Era Infra Engineering Limited (EIEL) [International Commercial Arbitration under the aegis of LCIA] 

 Role: Counsel for Era Infra Engineering Limited (EIEL) 

 This was an extremely complex matter related to derivatives with no or very few precedence in hand. On behalf of EIEL, S&A successfully cross examined the witnesses of the Deutsche Bank (with whom the derivatives transactions were undertaken) including its Expert Witnesses. The matter was decided in favour of EIEL.  

Jindal ITF Limited (JITF) vs NTPC Limited (NTPC) [Domestic Commercial Arbitration, Hon’ble Delhi High Court and Hon’ble Supreme Court] 

Role: Counsel for Jindal ITF Limited (JITF)  

S&A lead by Mr Manoj K Singh represented JITF in the arbitration. The matter is unique from various perspectives. In this matter, during the interim stage, the Hon’ble Tribunal directed NTPC to pay to JITF an amount of around INR 355 Crores, which was duly upheld by Hon’ble Supreme Court.  

ZaZa Energy LLC (ZaZavs Sankalp America Inc; [Case No. 2013-14715 at District Court of Harris County, Texas, 269th Judicial District]  

Role: Advisor to JSL 

Role: Mr Manoj K Singh, Expert Witness for Defendant 

ZaZa lodged a claim against Sankalp America Inc and Jindal Saw Limited (JSL). Against JSL, ZaZa lodged a claim of $44 Million on the ground of (1)  strict liability for (a) manufacturing defects; and (b) marketing defects; (2) negligence in the (a) manufacture of the Coupling Stock; and (b) marketing of the Coupling Stock; (3) breach of express warranty; and (4) breach of implied warranty of merchantability.  

While S&A was advising JSL, Mr Manoj K Singh’s role was of an Expert Witness on Indian Law from the Defendant’s side. In the final verdict, the Court was pleased to dismiss the claim of ZaZa and also awarded Cost of Proceedings in favour of JSL. 

National Highways Authority of India vs. PNC-BEL (JV) (Hon’ble Delhi High Court and Hon’ble Supreme Court) 

 Role: Counsel for PNC-BEL (JV) 

 In this case, Mr Singh acted as the lead Counsel on behalf of PNC-BEL (JV). The Award was passed in favour of PNC-BEL (JV) on 20.09.2018 and by August 2019, the entire Award amount including interest to the tune of INR 142 Crores was recovered by PNC-BEL (JV), even without deposit of any Bank Guarantee.  

 Mr. Manoj K. Singh appeared on behalf of PNC-BEL (JV) and got the case dismissed at the first hearing.

 West Haryana Highways Projects Private Limited (WHHPPL) Vs. NHAI (Domestic Commercial Arbitration and Hon’ble Delhi High Court) 

 Role: Lead Counsel for West Haryana Highways Projects Private Limited (WHHPPL)  

This is a landmark awardwherein the Tribunal after trial has found that NHAI was in breach of its contractual obligations and as per Clause 35.2 of the Concession Agreement, the Contractor is entitled to damages.  

 GuarantCo Limited vs Calcom Cement Limited (Calcom) (Hon’ble National Company Law Tribunal) 

 Role: Counsel for Guarantco Limited  

 Mr Manoj K Singh acted as the lead Counsel on behalf of GuarantCoThe Learned Bench allowed the Petition filed by GuarantCo and also admitted the application under Section 7 filed by GuarantCoMr Singh also helped GuarantCo in the settlement process and GuarantCo was able to recover the dues which were pending since the year 2009.
