The firm: Grinberg Cordovil Advogados is a dedicated boutique boasting solid skills in anti-competitive behavior investigations and merger control filings before CADE. GCA is widely recognized and with extensive experience in antitrust/competition law, particularly in complex and demanding cases, such as cartels, unilateral and dominance cases, or complex and sensitive merger filings. Additionally, GCA has extensive experience in negotiating leniency and settlement agreements before the Brazilian Antitrust Authority (cases will not be mentioned, per client requests) as well as in developing compliance programs and providing training for all clients mentioned below. Main areas of practice
Competition and antitrust: the firm has recognized and solid know-how in assisting clients in all aspects of competition law. GCA’s experience specifically includes dealing with (i) complex mergers and acquisitions, horizontal mergers, vertical integrations, joint ventures, associate agreements, and challenges to transactions before the Brazilian Antitrust Authority (“CADE”); (ii) administrative proceedings before CADE and/or lawsuits before the Judicial Courts in matters related to infringing conducts, such as cartel prosecution, refusal to sell, sham litigation, price discrimination, resale price imposition, predatory or abusive pricing or conducts; (iii) preventive assistance and advisory services; and (iv) preparing and implementing compliance programs within these matters. The firm is also frequently selected to represent clients present in challenging, niche, and/or innovative industries, including search engines, marketplaces, internet and telecom services providers, and technology, evidencing the team’s ability to work in those markets.
International trade and customs: GCA actively represents the domestic industry, importers, exporters, associations, and governments in antidumping, subsidies, and safeguard investigations, as well as tariff changes, including the List of Exceptions to the Common External Tariff – LETEC. The firm also works extensively in providing legal services to clients before (i) the Ministry of Development, Industry and Commerce – MDIC; (ii) the Chamber of Foreign Trade -CAMEX; (iii) and the Ministry of Finance, more precisely the Office of Economic Supervision – SEAE; as well as preparing advisory services and consultation in foreign trade. The firm is proud to say that it was one of the pioneers in representing clients in antidumping investigations in Brazil.
Compliance and anti-corruption: the firm has been actively assisting clients in conducting internal investigations and interviews, as well as establishing and implementing anti-corruption programs and policies in accordance with international and Brazilian laws and best practices. GCA also represents clients in negotiation of leniency agreements with the Brazilian authorities.
