Position
Richard Harrison specialises in commercial litigation and arbitration, especially insurance and reinsurance (including Bermuda Form) and professional negligence. Over the last two decades, Richard has developed a deep involvement within the insurance industry.
Many high-profile cases in arbitration. Reported cases include Phoenix Engineering v UK Insurance (UKSC), Rathbone Brothers v Novae (CA) and EL Trigger (UKSC). Recent high-profile cases include Grenfell Tower, the Not-Petya Ukranian Cyber-attack, newsworthy aviation grounding claims, South Korean toxic humidifier disinfectant death/injury claims, Petrobras corruption claims, export credit insurance (leading defence contractor), liability of offshore professional trustees, World Trade Center arbitrations, the British Airways Heathrow data centre business interruption claim, antisuit injunctions, satellite fuel leak claim, LEC-B etc. exclusions, advising on bespoke merger and acquisition policies, including pension scheme liability coverages.
Richard’s opinion with Colin Edelman QC, commissioned by Mactavish with the endorsement of Lloyd’s, the LMA, IUA, ABI, BIBA, LIIBA and AIRMIC, was deployed in the House of Lords debate on the Enterprise Act 2016. It formed the basis for amendment of late payment provisions of the Insurance Act 2015.
