Partner with the Employment team at Hayes solicitors. Anne has considerable experience advising and representing employers and employees on all aspects of the employment relationship from pre-employment matters to termination. She also advises on administrative law, industrial relations, data protection, health & safety and immigration. Anne has specialist knowledge particularly in relation to equality as it relates to the employment relationship. She brings a broad business perspective and international outlook to her client work. Before joining Hayes, she worked in the associated law firm of one of the ‘Big Four’ accounting firms and in the commercial litigation department of one of Australia's leading law firms. Anne provides an ‘on call’ advisory service to several clients, including membership-based associations. She deals with “on the spot” enquiries by providing advice and guidance on employment law matters. This saves time and costs for the client and is a valued client service. Anne advises senior executives and employees in relation to issues in the workplace including reviewing contracts, advising on difficulties at work and issues regarding termination of employment. She tailors best practice handbooks to the needs of each client’s business to ensure clear, user friendly and workable documents including grievance and disciplinary, bullying, data protection and maternity related policies. Anne has particular expertise in reviewing documents form foreign jurisdictions for companies entering the Irish market and has a specialist interest in and knowledge of the voluntary and NGO sector. Anne advises numerous clients on an ongoing basis including providing “on the spot” HR advice and guidance.
Breda O'Malley
Breda O'Malley
Partner with extensive experience in advising clients of our Corporate and commercial and Employment Law departments. Breda has particular expertise in employment law, advising both employers and employees on all aspects of the employment relationship, including terms and conditions of employment, equality matters and industrial relations issues. She proactively works to resolve employment disputes in a conciliatory manner where feasible. Breda handles employment law claims directly herself without Counsel in the Employment Appeals Tribunal, the Equality Tribunal and other industrial relations fora. She has a wide range of experience in dealing with commercial disputes, with a focus on resolving them at the earliest stage possible. Her commercial litigation experience extends across the range of civil courts in Ireland. She has extensive experience of drafting and negotiating commercial contracts at the different levels of the business supply chain. She advises on a wide range of legal queries for businesses across a range of sectors including retail, logistics, aviation and others. Breda is a CEDR (Centre for Effective Dispute Resolution) accredited mediator and practices as a mediator of commercial and employment disputes. She is currently a Council Member of the Irish Commercial Mediation Association. She is also a member of One Resolve, a panel of accredited mediators with legal, financial and insurance expertise. She regularly gives management and staff training workshops and up-skilling practical seminars to employer business clients on employment law issues. She has presented widely to trade and professional groups and at high profile conferences on topics including outsourcing, shared services, agency workers and the Working Time Directive and TUPE regulations. Breda trained with Hayes solicitors and then worked as an in-house Solicitor in Coca Cola before spending 12 years practising commercial and employment law in a large Dublin firm. She rejoined Hayes as a partner in 2008.
Caroline Crowley

Partner in the Healthcare department and Head of Regulatory & Administrative Law Caroline practises in and advises on a wide range of legal areas, and has over 25 years’ experience in civil litigation with particular emphasis on professional negligence including medical, dental and veterinary negligence. Caroline has extensive experience in complex cerebral palsy and high value catastrophic injury claims on behalf of hospitals. She also advises on disciplinary hearings before the Medical, Dental and Veterinary Councils and on ethical issues. Caroline has acted in a number of High Court challenges of decisions of the Medical Council which resulted in chanes to the Council’s practices and procedures. Caroline also has an interest in alternative dispute resolution and is accredited as a mediator by CEDR (the English Centre for Effective Dispute Resolution). She has lectured on various topics including claims handling, informed consent and the Medical Practitioners Act. Caroline has assisted a number of clients in successfully lobbying the Minister for Health and the Minister for Justice in relation to proposed legislative enactments. She is a French and Italian speaker.
David Phelan
David Phelan
David is Head of the Commercial Business Law Team. David advises on a wide range of commercial law issues and represents clients in commercial disputes. He advises on general corporate and commercial matters and has particular experience in the manufacturing and retail sectors. David also has considerable experience in dealing with competition law issues and has represented numerous businesses and individuals in Competition Authority investigations and criminal prosecutions. He has extensive experience in advising on intellectual property rights issues and is a registered trade mark agent. He also advises on regulatory matters, and is a key member of the firm’s media and defamation team. David frequently lectures on these areas, including tutoring in commercial law with the Law Society of Ireland, and works closely with clients in providing training to their personnel.
Jackie Buckley

Partner and Head of Property and Private Client Jackie advises clients in the banking, public and retail sector. She has been involved in some of the most prestigious developments in recent years. She has assisted her retail clients in the sale, purchase, lease and development of substantial retail stores, including mixed residential and commercial centres. She has also been involved in advising on the property aspect of mergers, acquisitions and management buy outs. She acts for a large number of Banks in relation to the putting in place of security over residential and commercial properties. As such, she advises Banks in all aspects of its lending, from the drafting of the facility letter to the perfection of the security. She advises Banks in relation to the enforcement of security. During the course of this work she advises on title issues and prepares certificates of title for the Bank. Jackie advises Receivers on queries arising post appointment, including title issues, concerns relating to Landlord & Tenant law and licensing matters. She is also involved in the sale of a number of properties on behalf of Receivers. Jackie advises professionals - including medical practitioners, dentists and accountants - on regularising their property affairs. She advises on the property side of partnership agreements and has advised on and drafted appropriate co-ownership agreements. She has written articles for publication on these issues and has lectured to relevant professional bodies. Through her participation in the Dublin Solicitors Bar Association and in particular the Conveyancing Committee, she has been involved in the making of submissions for The Law Society of Ireland which has impacted on how property transactions are carried out and the giving of commercial undertakings in property transactions.

Joe is Manageing Partner and Head of Litigation & Dispute Resolution. Joseph works extensively in the area of commercial dispute resolution and commercial litigation. He has significant experience in handling cases before the Commercial Court. He represents the State Claims Agency in respect of Employer/ Public Liability claims. Joseph has particular expertise in advising clients on regulatory matters and has advised the US Securities and Exchange Commission in relation to their investigations in Ireland. He has lectured to the Central Bank of Ireland also on this area. Joseph has been involved in the prosecution and defence of some of the most high profile professional negligence actions in the State. He also advises the Royal Institute of Architects in Ireland with regard to their regulation of architects. He also advises regularly on matters relating to freedom of information, data protection, intellectual property, insolvency and restructuring. Joseph advises numerous companies, liquidators and receivers in relation to insolvency matters. He also acts on behalf of National Asset Management Agency (NAMA). He advises Ireland's leading national newspaper on various media law matters including defamation. He represented Donal Kinsella in the largest defamation/ jury award to date in the history of the State. Joseph lectures widely in various aspects of commercial law and he regularly addresses clients, the Institute of Chartered Accountants and the Central Bank of Ireland on topical issues of business law.

Partner in the Healthcare team at Hayes solicitors, Kevin has substantial court and litigation experience, having acted for a wide variety of plaintiffs, as well as on behalf of a number of insurance companies in the defence of personal injury actions. He specialises in professional negligence with particular emphasis on the defence of medical, dental and veterinary negligence claims. He also advises professionals on all regulatory matters from dealing with complaints to their respective regulatory bodies, such as the Medical Council of Ireland, through to conclusion of the process. Kevin also represents doctors at inquests. He has represented a substantial number of doctors and hospitals on behalf of the Medical Protection Society (MPS) and State Claims Agency (SCA) in medical negligence claims. This work includes representing professionals at Inquests around Ireland. Kevin also advises the Medical Protection Society and its member doctors on all regulatory matters including attending before the Medical Council of Ireland. He advises professionals involved in investigations or disciplinary matters. He advises dentists individually and on behalf of Dental Protection. He also advises the Veterinary Defence Society in relation to complaints and material damage claims against veterinary surgeons.

Louise works closely with healthcare professionals involved in internal investigations and on regulatory issues coming before the Medical Council and the Dental Council. She is an experienced advocate before the Coroners courts. She has a significant non-contentious practice, advising on disclosure of records, Freedom of Information and Data Protection and the many discrete issues that arise in the course of daily practice.

In recent years Matthew has acted in both the prosecution and defence of significant loan recovery proceedings and is currently acting in the defence of very substantial construction/energy claims before the Commercial Court. His considerable experience of alternative dispute resolution mechanisms includes acting in a number of successful mediations to resolve large commercial claims. Matthew is an experienced commercial lawyer and advises a number of Irish and international clients on a wide range of commercial matters, including consumer law, contract law and intellectual property law. Matthew has a specialist interest in professional regulatory matters, particularly with regard to the veterinary profession, and has extensive experience in defending complaints before the Fitness to Practise Committee of the Veterinary Council of Ireland.
