New wins in two disputes: INTEGRITES successfully protected interests of a German company in a dispute against NNEGC Energoatom

INTEGRITES successfully protected interests of a German equipment manufacturer before the Commercial Cassation Court in a dispute related to the recovery of inflation losses and 3% of the annual interest rate in the amount of UAH 6 mln. The dispute arose due to failure of NNEGC Energoatom, one of Ukraine’s largest energy generating state-owned enterprises, to pay the long overdue debt for the special equipment supplied by the firm’s client to SSE Chornobyl NPP.

Additionally, the Domestic Litigation team represented the client in another dispute related to the recovery of principal debt by cancelling the enforcement officer’s decision as of 2007 to close the enforcement proceedings. First, the lawyers proved before the Supreme Court the grounds to renew the deadline for appealing the enforcement officer’s decision. Later the Kyiv Court of Appeal cancelled this decision which enabled the client to recover the principal debt in the amount of almost UAH 7 mln.

The litigation strategy developed by the firm’s lawyers entailed the successful outcome for the client in both abovementioned disputes.

Earlier INTEGRITES won the case related to the recovery of inflation losses, as well as 3% of the annual interest rate of the overdue debt from the state enterprise before the Court of appeal.
