Position

Daniel Villanueva Plasencia is a partner in the Intellectual Property Practice Group at Baker McKenzie Guadalajara. With over 15 years of experience, he specializes in data privacy, information security, and cybersecurity matters. His expertise extends to regulatory issues related to information technologies and consumer protection, as well as intellectual and industrial property – with a particular focus on digital environments, including the use and licensing of trademarks, patents, and copyrights. Daniel holds the Certified Information Privacy Administrator (CIPM) recognition from the International Association of Privacy Professionals. In 2022, Daniel was honored with the Innovation and Best Practices in Data Protection award by the National Institute of Transparency, Access to Information and Protection of Personal Data (INAI). Additionally, Daniel, obtained a certification as an Artificial Intelligence Compliance Officer from NYCE. Prior to joining the Firm, Daniel was a founding partner at a local firm in Guadalajara, Jalisco. Over the last eight years, Daniel has also been an instructor for the intellectual property class at the Tecnológico de Monterrey, one of Mexico's most prestigious universities.

Career

Daniel collaborates with clients across a diverse range of industries, with a particular focus on matters where there is an intersection between intellectual property and technology. Daniel's expertise extends to assisting technology companies in cross-border transactions, where he engages in drafting and negotiating commercial agreements - including licenses for the use of software and other innovative technologies. Additionally, Daniel provides guidance to software developers, hardware manufacturers, video game creators, social networks, e-commerce platforms, and internet companies worldwide. His advisory services cover a broad spectrum, including regulatory restrictions, intellectual property, data privacy and security. Daniel provides advice on global data privacy, data protection, cybersecurity, digital media, and other legal and regulatory issues. Daniel has experience in all aspects of data privacy and protection planning and implementation; licensing and transfer of technology, including trademarks, patents, copyrights and trade secrets; franchising and confidentiality; and handles domain name disputes and other infringements in Mexico and internationally. He also has a vast experience in rights of publicity, talent representation, media, and entertainment issues, such as online broadcasting, rights negotiation, negotiations with partnerships and content licensing. Daniel has assisted companies of all sizes—ranging from Fortune 500 to small businesses—in responding to cybersecurity incidents, including ransomware attacks, fund transfer fraud, data breaches, and business email compromise matters. Daniel takes an end-to-end approach to cybersecurity and data protection, covering threat intelligence, proactive risk management measures, immediate crisis response, and subsequent investigations and litigation.
